General terms of sale

These terms govern the contractual sales relationship between Jamonarea Online SL (hereinafter, “the seller”) and any person who purchases products through the website jamongourmet.es (hereinafter, “the customer”). They are drafted in accordance with Spanish Royal Legislative Decree 1/2007, the consolidated text of the General Law for the Defence of Consumers and Users (TRLGDCU) and Spanish e-commerce regulations.

An effort has been made to use clear and comprehensible language, in accordance with article 80 TRLGDCU.

Identity of the seller

Products for sale

Through the website, hams, shoulders, cured meats and cured meat products are marketed, all of them produced by F. Hernández Jiménez e Hijos S.L. in Guijuelo (Salamanca), under the trademark Hernández Jiménez and, when so expressly indicated on the product page, covered by the Guijuelo Protected Denomination of Origin.

The product images and descriptions are merely indicative, given the artisanal nature and the natural variability of the cured product.

Prices

Availability

The product offer is subject to available stock. If, once the order has been placed, it is not possible to supply any of the products due to a stock shortage, the customer will be informed as soon as possible and a full refund of the corresponding amount for the unavailable product will be issued or, if preferred, it will be replaced with an equivalent product.

Purchase process

  1. Selection of products and addition to the cart.
  2. Cart review: quantities, prices and shipping costs.
  3. Checkout: entry of the shipping and billing details.
  4. Payment through the enabled gateway.
  5. Confirmation: the customer will receive a confirmation email with the order summary and the receipt.

The order confirmation by email constitutes the conclusion of the sales contract.

Accepted payment methods

Transactions are processed through certified external providers. We do not store full card details on our servers.

Billing

Right of withdrawal and exceptions

IMPORTANT: Perishable food products are not subject to return for hygiene and health reasons in accordance with art. 103 of Spanish Royal Legislative Decree 1/2007 (TRLGDCU), except for a verified defect or a shipping error.

Consequently, the right of withdrawal provided for in articles 102 et seq. of the TRLGDCU does not apply to most of the products marketed on this site, as they are goods that may deteriorate or expire rapidly (art. 103.d TRLGDCU) and/or sealed goods that are not suitable for return for health-protection or hygiene reasons and that have been unsealed after delivery (art. 103.e TRLGDCU).

This limitation does not affect your legal rights in the event of a defect, lack of conformity or shipping error, governed by the following clauses and in the shipping and returns policy.

In accordance with the TRLGDCU, the products carry a legal guarantee for lack of conformity of 2 years from delivery for defects of origin. In the event of a lack of conformity, the customer will have the right to repair, replacement, a price reduction or termination of the contract, under the terms provided for in consumer regulations.

In the case of perishable food products, the guarantee will be exercised in accordance with the nature of the product and within its best-before date.

The house’s commercial guarantee

In addition to the legal guarantees, Hernández Jiménez offers its commercial commitment: if the customer receives a product with any problem attributable to the seller or the manufacturer, a full refund of the amount or replacement of the product will be issued, at the customer’s choice, with no more procedure than communication with photographic evidence to customer service.

This commercial guarantee extends and does not replace the consumer’s legal rights.

Dispute resolution

In accordance with Regulation (EU) 524/2013, the consumer is informed of the existence of the European online dispute resolution platform (ODR), accessible at:

For any dispute arising from the contract, the jurisdiction of the consumer’s domicile will be competent, in accordance with consumer-protection regulations.
